I would sooner receive injustice in the Queen's courts than justice in a foreign court. I hold that man or woman to be a scoundrel who goes abroad to a foreign court to have the judgments of the Queen's courts overturned, the actions of her Government countermanded or the legislation of Parliament struck down.

The trial can only end in a mistake because it is founded on one. How can a foreign court try a sovereign government of another country? Could we have tried your President Franklin Delano Roosevelt and Secretary Henry Morgenthau, or Winston Churchill and Anthony Eden, if we had won the war? If no one can appeal to justice except to government, justice will be perverted in favor of the government, constitutions and supreme courts notwithstanding. Constitutions and supreme courts are state constitutions and agencies, and whatever limitations to state action they might contain or find is invariably decided by agents of the very institution under consideration. Predictably, the definition of property and protection will continually be altered and the range of jurisdiction expanded to the government’s advantage until, ultimately, the notion of universal and immutable human rights – and in particular property rights – will disappear and be replaced by that of law as government-made legislation and rights as government-given grants.
