We permit absolute possession of the soil of our country, with no legal rights of existence on the soil to the vast majority who do not possess it. A great landholder may legally convert his whole property into a forest or a hunting-ground, and expel every human being who has hitherto lived upon it. In a thickly-populated country like England, where every acre has its owner and its occupier, this is a power of legally destroying his fellow-creatures; and that such a power should exist, and be exercised by individuals, in however small a degree, indicates that, as regards true social science, we are still in a state of barbarism.

State and government are the social apparatus of violent coercion and repression. Such an apparatus, the police power, is indispensable in order to prevent anti-social individuals and bands from destroying social co-operation. Violent prevention and suppression of anti-social activities benefit the whole of society and each of its members. But violence and oppression are none the less evils and corrupt those in charge of their application. It is necessary to restrict the power of those in office lest they become absolute despots. Society cannot exist without an apparatus of violent coercion. But neither can it exist if the office holders are irresponsible tyrants free to inflict harm upon those they dislike.

From whence are these "rights of individuals" derived, and why should we care? Unless we presume the existence of some greater power that determines what is good, isn't it arbitrary to posit that human survival is more important than private property rights, an equally artificially construed concept? Isn't it arbitrary to assume that some sort of equality is preferable to a system where, say, the poor are assumed to have bad karma? If these 'rights of individuals' are derived only from shared humanity, then do 'individuals' (a thoroughly meaningless term, by the way), begin to lose them when they act inhumanely? And isn't it totally arbitrary to grant rights to humans rather than other creatures anyway?

Where they do wrong it is even more important to punish them than to punish as small man who does wrong, because their position makes it especially wicked for them to yield to temptation; but the prime need is to change the conditions which enable them to accumulate a power which it is not for the general welfare that they should hold or exercise, and to make this change not only, without vindictiveness, without doing injustice to individuals, but also in a cautious and temperate spirit, testing our theories by actual practice, so that our legislation may represent the minimum of restrictions upon the individual initiative of the exceptional man which is compatible with obtaining the maximum of welfare for the average man.

"The 'state' on the modern conception is a legally defined term which refers, at the level of substance, to a state power that possesses both internal and external sovereignty, at the spatial level over a clearly delimited terrain (the state territory) and at the social level over the totality of members (the body of citizens or the people). State power constitutes itself in the forms of positive law, and the people is the bearer of the legal order whose jurisdiction is restricted to the state territory. In political usage, the concepts 'nation' and 'people' have the same extension. But in addition to its legal definition, the term 'nation' has the connotation of a political community shaped by common descent, or at least by a common language, culture, and history. A people becomes a 'nation' in this historical sense only in the concrete form of a particular form of life.
